摘　　要：互联网平台金融的多节点、快速化和虚拟性,开启了较传统金融更多的危险源,而“新危险源的开启、预防和控制”则需要与之相对应且更为严格的信息披露法律规范。国家加强对互联网平台金融的监管,标志着我国理论和实践对互联网平台金融的批判和改革,但不应该简单地将其理解为对互联网平台金融内在价值的全面否定,而应该视为对互联网平台“金融脱媒”“信息配置”“风险分配”“有效市场”和“理性市场”过度解读的反思和检讨。批判与改革是金融创新过程中的新常态,互联网平台金融的试错、纠正、完善和发展与新金融监管立法并行不悖。当务之急是,纠正长期以来互联网平台金融领域中的去监管化思想,将其纳入大金融监管范畴,完善信息披露制度,在创新与规范、安全与效率、制度刚性和操作弹性之间,合理界定市场主体信息披露边界和责任,建立与互联网底层技术相适应的信息披露侵权判定标准和法律责任承担机制。The multi-node, rapidity and virtuality of Internet platform finance open up more risk sources than traditional finance, and “the opening, prevention and control of new risk sources” need more strict legislation for information disclosure. The behavior of strengthen the supervision of internet financial platform sent a signal of criticism about China’s internet financial platform. However, it should not be simply interpreted as a comprehensive denial the value of internet financial platform. Instead, it should be regarded as a reflection about the over-interpretation of “financial disintermediation”, “information allocation”, “risk allocation”, “efficient market” and “rational market” on the Internet platform finance. Criticize and reform are the “new normal” in the process of financial innovation. Trial and error, correction, improvement and development of Internet platform finance are in parallel with new financial regulation legislation. The priority is to rectify the deregulation idea about internet platform finance, bring the internet platform finance into the system of financial supervision, improve the information disclosure system, define the boundary and responsibility of information disclosure under the innovation between standardization, the safety between efficiency, the system rigidity between executive flexibility, and establish the information disclosure infringement judgment standard and legal responsibility accountable mechanism adapt to the technology of internet.
