摘  要:我国已经形成了以《公务员法》为统领,以《党政领导干部任职回避暂行规定》《公务员回避规定(试行)》为主干,以部门规章和地方规定为细则的公务员任职回避规范体系。但在回避制度的名称、内容上,公务员任职回避制度还不够系统和精细。相反,在不同的规范之间还潜存着深层次的冲突和难以调和的矛盾,导致该制度的实施效果欠佳,与依法治国和依规治党的统一、协调还有较大差距。应当适时开展党内法规清理工作,健全公务员任职回避法律体系,并加强公务员的素质教育,实现外部约束和公务员内心自觉的有效结合。China has formed a normative system on avoidance in civil servants’assignment under the guidance of The Civil Servant Law,with The Interim Provisions on the Avoidance in Assignment of Party and Government Leading Cadres and The Civil Servant Avoidance Regulations(Trial)as main norms,and departmental rules and local regulations as detail rules.However,in terms of the name and content of the avoidance system,the avoidance in assignment of civil servants is not systematic and precise enough.Conversely,there are still deep-seated conflicts and irreconcilable tensions among different norms,which lead to poor effect in implementation of this system,leaving a big gap between the unification and coordination of“law-based state governance and regulation-based party governance”.It is necessary to check up laws and regulations of the Party in a timely manner,improve the legal system of avoidance in civil servants’assignment,strengthen the quality education of civil servants,and realize the effective combination of external constraints and civil servants’inner consciousness.
