我国网络电视服务中体育赛事传播权的保护与欧美镜鉴

摘　　要：采用案例分析、法律解释等研究方法,以2020年修订的《中华人民共和国著作权法》(简称“新《著作权法》”)为依据,分析我国网络电视(简称IPTV)体育赛事传播侵权争议。中美两国在IPTV体育赛事传播侵权治理过程极其相似,欧盟法律将IPTV体育赛事传播权予以版权和广播组织权两层权利保护,欧盟成员国依据本国法律实际,规制非法IPTV体育赛事传播。欧美IPTV体育赛事传播保护对我国IPTV侵权认定具有重要启示:IPTV体育赛事传播侵权认定应重点考察侵权行为特征和整体侵害结果,区分点播侵权和直播侵权行为;IPTV体育赛事节目符合作品的“独创性”和“一定形式表现”构成要件,应纳入新《著作权法》的视听作品保护;IPTV体育传播侵权的司法认定应将体育传播产业的利益平衡纳入我国法律框架,才能促进IPTV体育传播产业的法治化、规范化发展。Using the methods of case analysis and legal interpretation,based on the revised"The Copyright Law of the People’s Republic of China"(abbreviated as the"new Copyright Law")in 2020,the paper analyzed infringement disputes of IPTV sports communication services in China.There are extremely similarities in the process of IPTV sports communication infringement governance between China and the United States.EU law divides into two layers of rights to protect IPTV sports events communication:copyright and broadcasting organization rights.EU member states regulate illegal IPTV sports communication under their law frameworks.The protection of IPTV sports events in Europe and the United States has important implications for the infringement identification of IPTV sports communication in China:The key to the infringement determination of IPTV sports event communication should focus on examining the characteristics of infringement and the overall infringement results,distinguishing between on-demand and live communication infringement;the live program of the IPTV sports event meet the elements of the work’s"originality"and"a certain form of expression"and is included in the protection of audiovisual works in the new Copyright Law;the balance of interests of the sports communication industry should be incorporated into the legal framework in China to promote its legal and regular development.
