网络不正当竞争中消费者权益保护问题探析

摘  要:网络不正当竞争行为不仅侵害了消费者的知情权、自主选择权,而且使经营者与消费者之间的冲突加剧。而将消费者利益作为重要保护对象的《反不正当竞争法》却存在消费者诉权缺失、法律责任规定模糊的问题,司法适用也呈现出消费者利益与经营者利益失衡的态势。为实现对消费者权益的保护,需要明确消费者在《反不正当竞争法》中的直接主体地位,将消费者利益作为独立的判断标准,赋予互联网消费者团体诉权。The market potential of the network economy is huge.In order to obtain more benefits,the competition of operators has been intensified,and unfair competition behaviors have emerged.Unfair competition on the Internet is mainly manifested in four types:improper evaluation,improper interception,commercial plagiarism and malicious destruction,which not only infringe on consumers'right to know,right to choose and privacy,but also cause conflicts between operators and consumers.However,the Anti-Unfair Competition Law,which regards the interests of consumers as an important object of protection,has problems such as the lack of consumers'right to appeal and the ambiguous provisions on legal responsibilities.The judicial application also presents a situation of imbalance between the interests of consumers and the interests of operators.In order to protect the rights and interests of consumers,it is necessary to clarify the direct subject status of consumers in the Anti-Unfair Competition Law,take consumer interests as an independent judgment standard,and give Internet consumer groups the right to appeal.
