摘　　要：随着新时代数字产业的蓬勃发展,有关数字作品的确权、发行、著作权人与二次销售所有权人的利益平衡问题凸显。首次销售原则给予转售人处分其所有作品的权利,同时该原则亦相对限制了著作权人的发行权。尽管实践中部分法院已将首次销售原则应用于数字作品转售案件中,但理论界与司法实践对此仍存在较大争议。数字作品的形式、载体、消费者需求已与传统版权作品大相径庭,因此,其在转售时会出现侵犯著作权人复制权等问题。而区块链所具备的去中心化、不可篡改、可追溯登记等特性以及智能合约的自动执行,可以有效解决数字领域首次销售原则的适用难题,从而推动首次销售原则从实践走进立法,为数字作品转售行为提供合法前提。With the vigorous development of digital industry in the new era,the balance of interests between the copyright owner and the owner of secondary sales of digital works is prominent.The first sale principle gives the reseller the right to dispose of all his works,and this principle also relatively limits the distribution right of the copyright owner.Although in practice,some courts have applied the first sale principle to digital works resale cases,there are still great disputes between theoretical circles and judicial practice.The form,carrier and consumer demand of digital works are quite different from those of traditional copyright works,so there will be some problems such as infringing the copyright owner’s reproduction right when they are resold.The characteristics of blockchain,such as decentralization,non tampering and traceable registration,can effectively solve the application problems of the first sales principle in the digital field,promote the first sales principle from practice to legislation,and provide a legal premise for the resale of digital works.
