摘　　要：树立新数据观,需要深入认识数据以及数据资源、要素、资产和资本,探索数字经济制度创新。从数据二元化结构的视角分析数据权属,进行数据权益的双层制度设计,形成以数据载体为基础、以承载的信息内容为抓手的数据权利行使结构。维护各数据主体的正当权益,确保数据交易更加稳定安全可靠,最大程度降低数据流动的权属不确定性,以此推动数字经济立法和数据要素市场化配置改革,促进数据流动共享和应用赋能,助力数字经济可持续健康发展。To establish a new data view,it is necessary to fully understand data and data resources,elements,assets and capital,and to explore innovation of digital economic system.We should analyze data ownership from the perspective of data dual structure and design a two-tier system for data rights,to form a data rights exercise structure based on data carriers and take the information content carried as the starting point.We should safeguard the legitimate rights and interests of each data subject,ensure that data transactions are more stable,secure and reliable,and minimize the uncertainty of data ownership flow,so as to promote the reform of digital economy legislation and market-based allocation of data elements,promote data flow sharing and application empowerment,and help the sustainable and healthy development of the digital economy.
