摘 要:《中华人民共和国电子商务法》中的“通知—删除”规则确立了发生知识产权侵权纠纷时的救济制裁保障机制,《中华人民共和国民法典》侵权责任编也对“通知—删除”规则进行了相关规定,但这些规定在具体适用过程中,存在风险分配不均、权利类型不明晰、权利滥用、电子商务平台角色定位不准确等一系列问题。应当统一以侵权法为基础进行规制,妥善分配风险,加重平台经营者相应法律责任;对知识产权权利类型予以细化,并分别制定适用规则;严格规范“通知权”的认定标准和行使方式。同时,应当强化电商平台经营者公共秩序管理权能,重新审视其社会职责以维护营商环境,而不能视之为纯粹的中间人。The "Notice-Takedown" rule in the E-Commerce Law of PRC establishes the relief,sanction and protection mechanism against intellectual property disputes. The Book Seven on Tort Liability of the Civil Code also has relevant provisions on such rule, but those provisions encounter a series of problems during their application such as unbalanced distribution of risks, unclear types of rights, abuse of rights, and inaccurate positioning of the role of e-commerce platforms. It is necessary to impose regulation on the uniform basis tort law by properly allocating risks and increasing the corresponding legal liability of e-commerce platforms;to refine types of intellectual property rights and respectively formulate relevant applicable rules;to impose strict regulation on the identification standards and exercise methods of the "notification right". Meanwhile, it is necessary to strengthen the function of e-commence platforms of managing public order, reexamine their social responsibility for maintaining the business environment instead of regarding them as a pure intermediary.
