整体法秩序中的网络平台法律责任体系界定

摘　　要：法秩序具有统一性,整体意义上的法秩序对于法律的体系治理具有重要作用。网络平台的法律责任主要围绕平台的管理内容而展开,涉及平台的法律责任问题时,难以在第一时间准确判断其究竟属于何种类型的法律责任,故各种法律责任体系在涉及平台责任的时候是难以果断划分的。在整体法秩序的视野下,网络平台的法律责任主要包括民事法律责任、行政法律责任和刑事法律责任,在对各自法律责任的内容予以一般界定的基础上,围绕着平台的管理职能以及整体法秩序的主线,应当注重不同法律责任之间的体系衔接与功能协同。一方面,涉及网络平台的不同法律规范应当及时被予以修正和完善,这是立法层面的协调;另一方面,应当在形式逻辑的基础上追求归责的实质合理性,加强法理层面的论证,这是司法层面的协调。在网络平台法律责任的理念与践行方面,坚持以民事法律责任为基础,以行政法律责任为辅助,以刑事法律责任为保障,将网络平台的法律治理置于整个法秩序的体系中。The legal order is unified,and the overall legal order plays an important role in the governance of the legal system.The legal responsibility of the network platform mainly revolves around managing platform contents.When it comes to the legal responsibility of the platform,it is difficult to accurately determine immediately what type of legal responsibility it belongs to or to divide legal responsibilities decisively as various legal responsibility systems are involved in platform responsibilities.From the perspective of the overall legal order,the legal responsibilities of the network platform mainly include civil legal responsibilities,administrative legal responsibilities,and criminal legal responsibilities.Based on the general definition of their respective legal responsibilities,which mainly revolves around the management functions of the platform and the overall legal order,platform legal responsibilities should be attributed to the system connection and functional coordination between different legal responsibilities.On one hand,different legal norms related to the network platform should be established in time and improved consistently,which involves coordination at the legislative level.On the other hand,it should,based on formal logic,pursue the rationality of accountability,which involves coordination at the judicial level.The concept and practice of the legal liability of the network platform should stick to the principle of civil legal liability as the basis,consider administrative liability as a supplement,and regard criminal legal liability as a guarantee,thus subjecting the legal governance of the network platform to the entire legal order system.
