环境法典的创制及其构想

摘　　要：随着民法典的颁布实施,法典化议题成为了一个热点学术话语,环境法法典化正是在这一大背景下予以展开。环境法典的创制有利于实现环境法律规范的体系化表达,有利于形成环境法律规范的逻辑自洽,有利于减少环境法律规范的适用冲突。创制环境法典需要有效的政治条件、成熟的法律体系、丰富的法治实践和优良的学术群体。我国环境法典的创制应当定位为全面型、实体型和汇编型环境法典,模式选择应当采用介于形式化环境法典模式和实质化环境法典模式之间的适度化环境法典模式。就体例构思来看,在“总则加分则”的基础上,将环境法典分则确立为污染防治法编、资源利用法编和生态保护法编,并且在这一体例之下可以对现有的主要环境法律予以分门别类的归入环境法典各编之中。With the promulgation and implementation of the Civil Code, the issue of codification has become a hot topic in academic discourse, and based on this context, the codification of environmental laws is carried out. The creation of the environmental code is conducive to the achieving the systematic expression, formulating the logical self-consistency, and reducing application conflicts of environmental legal norms. The creation of an environmental code requires effective political conditions, a mature legal system, rich legal practices and excellent academic groups. The creation of China’s environmental code should aim at establishing a comprehensive, substantive and compiled environmental code, and the mode selection should adopt a moderated environmental code model between the formal environmental code model and the substantive environmental code model. From the perspective of system design, on the basis of the “general rules plus specific provisions”, the environmental code is established as the pollution prevention and control law, the resource utilization law and the ecological protection law, and the current main environmental laws are classified into the various parts of the environmental code in this system.
