摘　　要：淫秽网络直播具有“低成本、高收益、难查处”的特点,其对纯净、健康、安全的互联网环境构成巨大威胁。淫秽网络直播既是淫秽表演,也是一种传播淫秽物品的活动。淫秽网络直播的主播、组织者可成立传播淫秽物品罪或制作、传播淫秽物品牟利罪,以及组织淫秽表演罪,而直播平台也可成立帮助信息网络犯罪活动罪或相关犯罪的共犯。The obscene webcast has the characteristics of "low cost,high profits and difficulty to investigate",which poses a great threat to the pure,healthful and safe Internet environment.The obscene webcast is not only a porn performance,but also an activity to spread porn items.The anchors and organizers of obscene webcast can be charged with the crime of disseminating porn items or the crime of making and disseminating porn items for profit,as well as the crime of organizing porn performances.In addition,the live broadcast platforms can also bee charged as accomplices to assist the cybercrime or related crimes.
