海南自由贸易港仲裁问题审视及机制创新

摘　　要：海南自由贸易港打造中国对外开放新高地,需要完善符合中国特色自由贸易港的营商环境制度。仲裁本应成为优化营商环境的重要保障,但在内部治理机制、仲裁规则和司法监督保障等方面所表现的竞争力、吸引力、公信力的问题依然存在,实践中并未成为当事人解决商事纠纷的最佳选择。在自由贸易港建设背景下,仲裁机制创新面临着新机遇与新要求,为服务自由贸易港高水平贸易投资自由化便利化的营商环境,需要发挥立法权优势以制定自由贸易港仲裁条例来提升仲裁公信力,优化治理机制和仲裁规则以凸显仲裁的国际化与特色化,完善司法保障仲裁事业发展以打造自由贸易港一流营商环境。While building a new highland for China’s opening up, Hainan Free Trade Port needs to improve the system that conforms to the business environment in the free trade port with Chinese characteristics. Arbitration should have been an important guarantee to optimize the business environment, but such problems as competitiveness, attractiveness and credibility still exist in the internal governance mechanism, the arbitration rules and the judicial supervision and guarantee. In practice, it fails to be the best choice for the parties to solve commercial disputes. In the context of the construction of free trade port, the innovation of arbitration mechanism is facing new opportunities and requirements. In order to serve the business environment of highlevel trade and investment liberalization and facilitation in the free trade port, it is necessary to give full play to the advantages of legislative power to formulate arbitration regulations of free trade port to enhance the credibility of arbitration, optimize the governance mechanism and arbitration rules to highlight the internationalization and characteristics of arbitration, improve the judicial guarantee for the development of arbitration to create a first-class business environment in the free trade port.
