强制执行权在国家权力体系中的定位:一个跨部门法的视角

摘　　要：以往关于强制执行权在国家权力体系中定位问题的研究存在严重的部门法化倾向,此种视野局限导致无法追本溯源地对作为一种权力类型的强制执行权作出准确定位。从跨部门法的视角出发,强制执行权的定位需抽象至整体的国家强制执行权并回溯至分权理论中去。在现代国家,立法权、行政权与司法权的概念,分别在权力形态和权力体系两个层面使用,分权理论是在权力体系层面的分权。强制执行权相对于其他权力类型而言,在权力形态层面具有相对独立性,而在权力体系层面则既可从属于行政权,亦可从属于司法权。另外,强制执行权的性质对其在实然层面的配置影响非常有限。我国对各部门法中强制执行权的配置,主要的考量因素是其功能的有效实现以及内部实施权与裁决权的相互制约。Previous studies on the positioning of enforcement power in state power system have a great tendency to departmental law. Such a limited perspective makes it impossible to accurately define enforcement power as a type of power in a retroactive way. From the perspective of inter-departmental law, the positioning of enforcement power should be abstracted to the national enforcement power and then relocated to decentralization theory. In a modern country, the concepts of legislative power, executive power and judicial power are used respectively at two levels of power form and power system, and the power in decentralization theory is at the level of power system. Compared to other power type, enforcement power is relatively independent at the level of power form while subject to executive power and judicial power at the level of power system. In addition, the nature of enforcement power has limited influence on the power distribution at descriptive level. The main consideration for enforcement power distribution in different departmental laws in China are the real effect of its function and the constraint between internal executive power and judicial power.
