摘 要:对于金融不良债权处置政策,我国法院通过制定司法文件的隐性方式,以及作为认定案件的事实依据、说理依据和裁判依据的显性方式进行了回应。这些回应在很大程度上已经超越了现行法律的规定,表现出明显的回应过度。出现该现象的根本原因在于司法文件和裁判跨越了法律系统的界限,忽视法律稳定规范性期望的功能强行进行回应,法院决策行政化和职能缺位。为扭转金融不良债权处置政策司法回应过度的现象,应在法律系统的界限以内引介政策、注重法律的稳定性、法院去行政化和严格履行裁判职责。With regard to the policy on the disposal of financial non-performing loans,China’s courts have responded through both the implicit way of making judicial documents and the explicit way of acknowledging this policy as the evidence of case facts,reasoning and judgement.These responses have,to a large extent,exceeded the provisions of the existing law,forming an over response.The cause of this phenomenon lies in judicial documents’and judgement’s overstep of the boundaries of the legal system,the forced response with ignorance of the law’s function of stable normative expectations,the administrated court decision and the court’s functional vacancy.In order to reverse the excessive judicial response to financial non-performing loans resolution policy,new policy should be introduced within the boundaries of the legal system,the stability of the law should be emphasized,the court should be de-administrated,and the adjudication should be strictly judged.
