摘　　要：跨国收养有复杂的历史原因、现实需求,各国的法律规范不同。针对困扰国际社会的儿童流离失所的社会问题,全书以解决跨国收养法律冲突为主题,以收养关系的成立、效力、解除为主线,以维护被收养儿童的最大利益为原则,回应并解决中国跨国收养的立法及司法困囿问题。通过考察国际社会探索解决跨国收养法律冲突的历程,在比较区域性和全球性做法之后,作者提出中国解决跨国收养法律冲突的对策。只有厘清中国涉外收养法律适用规范的基本理念和总体思路,并在涉外收养关系成立的实质要件、形式要件、效力、收养关系的解除等方面,重构中国涉外收养的具体法律适用条款,才能保护弃婴、孤儿、家庭无力抚养的子女等弱势群体的利益,为解决跨国收养法律冲突的中国经验与方案。Intercountry adoptions have complex historical reasons and practical needs,and different countries have different legal norms.In views of the social problems of children's displacement,which are generally perplexed by the international community,the whole book takes the resolution of the legal conflicts of intercountry adoption as the theme,the establishment,effectiveness and dissolution of the adoption relationships as the main line,and the principle of safeguarding the best interests of the adopted children as the principle,in order to respond to and solve the legislative and judicial difficulties of China's intercountry adoption.After reviewing the process of the international community in exploring ways to resolve the legal conflicts of intercountry adoption and comparing regional and global approaches,the author puts forward some countermeasures for China to resolve the legal conflicts of intercountry adoption.Only by clarifying the basic concepts and general ideas of China's Foreign-related Adoption legal application norms,and reconstructing the specific legal application provisions of China's Foreign-related Adoption in terms of the substantive elements,formal elements,effectiveness,and dissolution of the adoption relationship,can the interests of vulnerable groups such as abandoned babies,orphans,and children whose families can not afford to support be protected,can provide China’s experience and solutions to the legal conflicts of intercountry adoption.
