摘　　要：伴随着新一轮ISDS机制改革,国际社会正谋求新的争端解决方式以有效解决投资者与东道国之间的投资争端。以ICSID投资仲裁为核心的解决机制诟病重重,而以调解为主的替代性纠纷解决方式和预防机制日益重要。“一带一路”秉承共商共建共享原则,天然具有适用调解的利益与情感基础,应重视调解的价值。前置调解以对投资争端进行事前干预,构建并完善了调解先导的“一带一路”区域投资争端预防机制,支撑“一带一路”高质量共建。With a new round of ISDS mechanism reform,the international community is seeking new ways to effectively resolve the investment disputes between investors and host countries.ICSID investment arbitration as the core of the settlement mechanism has been criticized,but mediation based alternative dispute resolution and prevention mechanism is increasingly important.Adhering to the “area”discuss sharing principle,the interests of the natural with apply conciliation and emotional foundation,should pay attention to the value of mediation,lead to investment disputes conciliation prior intervention,build and perfect mediation leads all the way“area” regional investment disputes prevention mechanism,support the“neighborhoods”all the way to build high quality.
