我国劳动争议审判制度的现状与改革探析

摘  要:在我国现行的劳动争议审判制度下,劳动争议案件实行仲裁前置。即除小额及个别劳动争议外,较普通的民事诉讼案件多一个审判程序,事实上相当于三审终审。这不仅不利于及时有效地解决劳动争议,还大大增加了当事人诉累,并严重浪费司法资源。同时,小额及个别劳动争议案件的审理方式也是弊端重重。本文旨在通过对现存问题进行剖析与提出解决建议,以期尽快推进我国劳动争议审判制度的改革与完善。Under China’s current labor dispute trial system,labor dispute cases implement pre-arbitration.That is,in addition to small and individual labor disputes,more than ordinary civil litigation cases live more than a trial procedure,in fact,equivalent to the third trial final trial.This is not only not conducive to the timely and effective settlement of labor disputes,but also greatly increased the burden of litigation,and a serious waste of judicial resources.At the same time,the trial of small and individual labor dispute cases is also with many drawbacks.This paper aims to promote the reform and improvement of the labor dispute trial system as soon as possible by analyzing the existing labor dispute trial system.
