Judicial Review of the Revision of Measures for the Implementation of the Archives Law of the People's Republic of China--Based on the Data Analysis of 261 Documents on the Chinese Judgments Online

摘　　要：为考察人民法院适用《档案法实施办法》的案件类型、案由、涉案主体、援引情形等,采用文献计量分析法、内容分析法和个案研究法对中国裁判文书网261篇文书进行实证分析,发现在司法实践中存在档案馆利用服务行为性质不明,档案原始性遭到破坏和档案利用违规收费现象仍然存在等问题,并从明晰档案馆利用服务行为的性质,解决档案丢失补救问题和规范档案利用程序等方面对《档案法实施办法》与《档案法实施条例(修订草案征求意见稿)》提出修改建议。In order to investigate the case types, reasons, subjects involved, and citation situations to which the Courts apply the Measures for the Implementation of the Archives Law,this paper uses bibliometric analysis, content analysis and case study methods to empirically examine 261 documents on China Judgment Online, it is found that in judicial practice, there are problems such as the unclear nature of the service behavior of archives, the destruction of the originality of archives, and the difficulty in implementing the archives utilization charging policy.This paper puts forward suggestions for amendments to the Measures for the Implementation of the Archives Law and the Regulations on the Implementation of the Archives Law(Draft for Comments).
