档案行政处罚“双罚制”建构的证成与展开

摘　　要：从显化档案违法单位的个人责任、增强档案主管部门的执法效能、实现档案公共利益的充分维护角度看,档案行政处罚“双罚制”的建构具有现实必要性。威慑理论、同一视原理、风险预防理论可分别从压力传导、意志契合与载体变革等维度为档案行政处罚“双罚制”的建构提供理论支撑。环境保护、金融监管、食品安全、药品管理等领域“双罚制”的构成要件、处罚方式与主体范围为档案行政处罚“双罚制”的建构提供了可资借鉴的立法经验。建议通过修改《档案法》的处罚条款,采用“复合型”构成要件、“差异型”处罚方式与“扩充型”主体范围对档案行政处罚“双罚制”进行规范构造,以期完善档案违法追责制度与健全档案治理体系。From the perspective of manifesting the personal responsibility of archives illegal units, enhancing the law enforcement efficiency of archives competent departments and realizing the full maintenance of archives public interests, the construction of “bipartite punishment system” of archives administrative punishment is of practical necessity.Deterrence theory, the same view principle and risk prevention theory can provide theoretical support for the construction of “bipartite punishment system” of archival administrative punishment from the dimensions of pressure transmission, will fit and carrier change.The constituent elements, punishment methods and main scope of the “bipartite punishment system” in the fields of environmental protection, financial supervision, food safety and drug management provide legislative experience for the construction of the “bipartite punishment system” of archival administrative punishment.It is suggested that the “bipartite punishment system” of archives administrative punishment should be standardized by modifying the punishment provisions of the Archives Law and adopting the “composite” constituent elements, “differential” punishment methods and “expanded” subject scope, in order to improve the archives illegal accountability system and improve the archives governance system.
