《海商法》修订下关于船舶油污损害赔偿制度的研究

摘  要:船舶油污损害是海洋环境污染的重要来源,作为特殊的民事侵权,涉事船舶不论对自身还是对公共环境都带来了无法逆转的破坏,由于缺乏相应对策,我国每年发生的船舶油污损害事故不在少数,因此,建立健全相关保护制度尤为重要。通过分析我国关于船舶油污损害赔偿的立法及其缺陷,论证建立完备的海商法必要性;其次,在民法体系全面焕新的背景下,通过比较分析《海商法》修改建议稿之于现行《海商法》的修改增补之处,为今后的立法以及实务工作提出建议。总之,全面依法治国需要解决立法空白,建设海洋强国需要坚持立法先行。Ship oil pollution damage is a major source of marine environment pollution. As a pattern of special tort,such pollution can bring irreversible damage to both the ships themselves and the public environment. Due to the lack of relevant policies, accidents involving ship pollution damage happen frequently in China every year, making it crucial for the establishment and development of relevant legal systems. Based on a study of the legislation of China on ship oil pollution damage compensation and the inadequacies,the paper addresses the necessity of improving the maritime law. Furthermore, under the background of the new civil law regime, the paper identifies the amendments contained in the proposed draft of Maritime Code in comparison with the existing Maritime Code, providing suggestions for future legislation and practice. To summarize, it is necessary to fill in the gaps in legislation in order to pursue rule of law, and legislation should be addressed as the foremost in the efforts to develop China into a nation with marine strength.
