摘　　要：在信息化时代技术支撑的背景下,个人信息的采集、处理、传输、储存等技术大有进步,处置成本也大幅降低,社会生活中的方方面面可以信息或者数据的形式予以记载和利用,个人信息成为推动社会转型的重要决定性资源和力量。对个人信息的重视和保护也被提到了历史新高度。在我国社会转型的重要历史时刻,《个人信息保护法》应运而生,但在对个人信息的保护中不可避免地与社会公共利益产生矛盾和冲突。该种冲突的产生一方面有历史原因,另一方面也是对个人信息保护客体的认识误差所致。文章通过分析个人信息的内涵和我国个人信息保护的现有资源,对个人信息保护与公共利益矛盾产生的原因进行剖析,进而尝试找到该问题的破解之法。With the technical support of the unique times,personal information collection,processing,transmission,storage and other technologies have made great progress,and the disposal cost has also been greatly reduced.All aspects of social life can be recorded and utilized in the form of information or data,and personal information has become an important and decisive resource and strength to promote social transformation.The importance and protection of personal information has also been mentioned to a new historical height.At the important historical moment of China's social transformation,the Personal Information Protection Law came into being as the times require,but in the protection of personal information,it inevitably conflicts with the public interests.On the one hand,this kind of conflict is caused by historical reasons;on the other hand,it is also caused by the cognitive error of the object of personal information protection.By analyzing the connotation of personal information and the existing resources of personal information protection in China,this paper analyzes the causes of the contradiction between personal information protection and public interests,and then tries to find a solution to this problem.
