家事案件法官调查权本土化路径探析

摘　　要：结合家事案件法官调查权的实践现状及存在的问题,探索家事案件法官调查权本土化的路径:制定家事诉讼专门化法律,明确法官在家事调查中的职权、家事案件适用的诉讼模式、家事案件的范围与分类,在维护家庭和睦与弱势群体权益的基础上兼顾当事人和第三人的相关法益。Considering the practical status and existing problems of the investigation power of the family case judges, we explore the path of localization of the investigation power of the family case judges: formulating the specia-lized law of the family cases, clarifing the functions and powers of the judge in the family investigation, the applicable litigation mode of the family cases, the scope and classification of the family cases, and giving consideration to the relevant legal interests of the parties and the third party on the basis of maintaining family harmony and the rights and interests of the vulnerable groups.
