动产抵押登记对抗与抵押权顺位规则的冲突适用

摘　　要：《民法典》403条、414条分别对动产抵押登记对抗、顺位规则作出了规定。而登记对抗主义下的抵押权顺位却并不明朗,当抵押在先的抵押权人未登记,在后抵押的恶意抵押权人进行了登记时,不免引发是应当优先保护“善意”,还是优先保护“登记公信力”的价值抉择。文章从价值选择、比较法借鉴以及具体适用三个方面进行阐释,整理动产抵押权竞争时优先适用抵押权顺序规则的理由,对动产抵押登记对抗规则展开分析,明确动产抵押登记对抗规则的适用范围,推进动产抵押制度的完善,解决当前动产担保利用率低,流通慢应对融资困难等经营环境的难题。Articles 403 and 414 of the Civil Code stipulate the confrontation and ranking rules of chattel mortgage registration respectively.However,the priority of mortgage under registration antagonism is not clear.When the mortgagee who mortgages first is not registered and the malicious mortgagee who mortgages later is registered,it inevitably leads to the value choice of whether to give priority to the protection of"goodwill"or"registration credibility".This paper explains it from four aspects:value selection,comparative law reference,specific applica⁃bility and judicial practice,sorts out the reasons for the priority application of the sequence rules of mortgage,and analyzes the confrontation rules of chattel mortgage registration,Promote the improvement of chattel mortgage system.
