新修订《体育法》背景下中国体育仲裁程序建构路径研究——基于对韩国、日本、土耳其等国体育仲裁程序的考察

摘　　要：随着《体育法》的修订,我国独立体育仲裁机构的建立逐渐提上日程。体育仲裁相较于其他仲裁,在原则、制度以及具体程序上都存在其特殊性。科学、合理的仲裁程序对于独立体育仲裁机构的建立举足轻重。基于我国体育纠纷的特殊性和纠纷解决的实际需求,结合国际上成熟体育仲裁中心的程序规则,建立完善的体育仲裁程序是建构我国独立体育仲裁机构的重要一环。以韩国、日本、土耳其等国仲裁实践为考察对象,对其仲裁受理、仲裁协议、仲裁庭的组成、仲裁审理等仲裁程序进行考察,总结其所具有的优势,进而提出我国体育仲裁制度建构中仲裁程序完善的具体路径:第一,细化并构建起普通、上诉、临时仲裁程序为一体的仲裁程序;第二,在仲裁员选任上充分尊重当事人意思自治;第三,在体育仲裁程序中前置紧急仲裁程序;第四,落实“或裁或审”体育仲裁机制。As the Sports Law has been revised,the establishment of China’s independent sports arbitration institution is gradually put on the agenda.Compared with arbitrations in other fields,sports arbitration has its particularity in principle,system and procedure.The establishment of an independent sports arbitration institution depends in large part on a scientific and reasonable arbitration procedure.Based on the particularity of sports disputes and the actual needs of dispute resolution in the country,a perfect sports arbitration procedure formulated by combining with the procedure rules of mature sports arbitration centers of other countries is an important part to establish an independent sports arbitration institution.This paper investigated the arbitration acceptance,arbitration agreements,composition of the arbitral tribunal,arbitration hearing and other arbitration procedures of Korea,Japan and Turkey and summarized these countries’advantages of their arbitration practice,and then proposed the following specific paths to improve arbitration procedures in the construction of China’s sports arbitration system:first,refining and building arbitration procedures integrating ordinary,appellate,and ad hoc arbitration procedures;second,fully respecting the autonomy of will of the parties concerned in selecting and appointing arbitrators;third,giving priority to emergency arbitration procedures in sports arbitration procedures;and the last,implementing the sports arbitration mechanism of"balance of arbitration and trial".
