摘　　要：数字经济时代,智慧体育场馆在服务全民健身战略与体育强国建设中发挥着关键作用。基于产业制度分析视角,对智慧体育场馆数据生产要素的价值生成路径与确权困境进行探讨,为数据要素驱动智慧体育场馆运营提出纾困策略。研究在厘清智慧体育场馆数据确权主客体的基础上,阐明了数据权利流转过程中参与智慧场馆运营所实现的“生产—分配—消费”3方面经济价值。针对现存法律适用性条文缺失、政府监管力度不强和公众保护意识欠缺的数据确权困境,文章提出建设智慧体育场馆适用的数据要素产权制度、促进行业公平竞争的法律规范落地和规范智慧体育场馆数据平台的数据使用行为,以规范和保护智慧体育场馆数据权利的合法行使。In the era of digital economy, smart stadiums play a key role in serving the national fitness strategy and building a strong sports nation. Based on the perspective of industrial system analysis, this paper discusses the value generation path and right confirmation dilemma of the data production elements of smart stadiums, and proposes a rescue strategy for data elements to drive the operation of smart stadiums. On the basis of clarifying the subject and object of data rights confirmation of smart stadiums, the research clarifies the economic value of "production-distribution-consumption" realized by participating in the operation of smart stadiums in the process of data rights transfer. Considering the dilemma of data rights confirmation due to the lack of existing legal applicability provisions, weak government supervision and lack of public awareness of protection, it is proposed to build a data element property rights system applicable to smart stadiums, implement legal norms to promote fair competition in the industry, and regulate smart stadium data. The data usage behavior of the platform is to regulate and protect the legal exercise of data rights in smart stadiums.
