出庭作证制度视角下提升警察法治观念的思考

摘　　要：近年来,我国公安机关大力推进法治建设,警察法治观念有了较大提升,在保障案件质量、提高执法效率和带动社会法治观念等方面都较好地彰显了其价值。同时,警察法治观念培育方式也面临科学性不足等问题。在“以审判为中心”的刑事诉讼制度改革大背景下公安机关推出侦查人员出庭作证制度,既是配合全面依法治国举措的同向发力,也是进一步提升警察法治观念的新路径,有助于倒逼警察在执法办案中有意识地强化权利保障思维、程序正义思维和证据规则思维等法治思维,推动其主动将全面依法治国的要求变成自觉认识。Public security organs in China have vigorously promoted the rule of law in recent years,and the police legal concept has been greatly improved,which has demonstrated its value in ensuring the quality of cases,improving the efficiency of law enforcement and driving the social concept of ruling by law. At the same time,the concept cultivation is also facing problems such as lack of science. The system of investigators testifying in court,launched by public security organs under the background of the trial-centered criminal procedure system reform,is not only the effort in concert with initiatives of comprehensively ruling the country according to law,but also a new path to further enhance the police legal concept. It forces the police to consciously strengthen the thinking of rights protection,procedural justice and evidence rules in law enforcement,and encourages the police to turn the requirement of comprehensively ruling the country according to law into a conscious understanding on their own initiative.
