《网络安全法》政策响应的文献量化研究——基于880份地方政策文本的分析(2016-2021)

摘　　要：《中华人民共和国网络安全法》是我国第一部全面规范网络空间安全管理方面问题的基础性法律,是我国网络空间法治建设的重要里程碑。《网络安全法》颁布五周年之际,通过政策扩散-响应理论对政策响应数据进行文献量化分析。论文通过政策响应区域和政策响应主题两个层面,以及响应强度、响应广度、响应时间三个维度研究政策响应的过程和特点。研究发现,响应政策覆盖31个省级行政区,主题主要包括政务信息化与数据安全、监督与管理、宣传与教育、产业技术发展、信息化建设、监测预警与处置办法、规划与治理七大类。政务信息化与数据安全是各级地方政府最为关注的主题。监测预警与处置办法是最新的关注点,落实工作有待加强。研究揭示了响应政策的主题变迁,挖掘了地方对《网络安全法》的落实情况,研究成果可以为政策制定提供支撑。The Cybersecurity Law of the People’s Republic of China is the first basic law to comprehensively regulate the management of cybersecurity,and is also an important milestone in the rule of Cybersecurity Law construction in China.On the fifth anniversary of the promulgation of the Cybersecurity Law,the policy response data are quantitatively analyzed through the policy diffusion-response theory.This research investigates the process and characteristics of policy response by exploring the region and topic of policy response,and applying 3-dimensional analysis,i.e.,response intensity,breadth and time.It is found that the response policy topics mainly include government informatization and data security,supervision and management,publicity and education,industrial technology development,information construction,monitoring and disposal,planning and governance.We found that government informatization and data security topic is the most concerned topic of local governments,the implementation of monitoring and disposal topic needs to be strengthened.The research reveals the topic changes in response policy,and excavates the local implementation of the Cybersecurity Law.The research results can provide support for policy formulation.
