对“合理期限”的解释及类型化研究——基于《民法典》第580条第1款第3项

摘　　要：非金钱债务继续履行的限制适用要件——“债权人在合理期限内未请求履行”,因“合理期限”的这一立法技术下的模糊表达,导致司法适用出现困难,有必要对“合理期限”的适用予以解释并作类型化分析。“合理期限”不同于诉讼时效和除斥期间,其是本质上属于失权期间,与合同解除合理期限以及检验期间同质。继续履行超期后的责任承担形式主要为损害赔偿。继续履行请求下的合理期限主要分为当事人约定期限类、许可资质与特定业务经营期限类、时令性标的物类、标的物价格波动类。在检验期间下,最长合理期限一般应为2年,除此之外,最长合理期限应以诉讼时效期间为衡量标准。The limiting element of the continuation of a non-pecuniary debt-"the creditor has not requested performance within a reasonable period of time"-has led to difficulties in its judicial application due to the ambiguous expression"reasonable period of time"under this legislative technique.It is necessary to explain and typify the application of the"reasonable period of time",as this vague expression of the"reasonable period of time"has led to difficulties in its judicial application.Unlike the statute of limitations and the exclusion period,the"reasonable period"is essentially a period of laches and is homogeneous with the reasonable period of termination of the contract and the test period.Liability for continued performance after the expiry of the period is mainly in the form of damages.Reasonable periods of time under a claim for continuation of performance are mainly divided into the category of the period agreed by the parties,the category of the period of license and specific business operation,the category of seasonal subject matter and the category of price fluctuations of the subject matter.Under the test period,the maximum reasonable period shall generally be two years,other than that the maximum reasonable period shall be measured by the limitation period.
