对个人信息许可使用规则构建的思考

摘　　要：信息主体对个人信息同时享有精神利益与财产利益,其财产利益可通过许可方式予以利用,对个人信息许可使用规则的研究有助于促进个人信息的有效利用。在讨论个人信息许可规则时,考虑到个人信息与知识产权客体具有相似特征,在规则构建上,可以参考知识产权许可模式。个人信息许可采用合同方式设立,并划分不同许可类型,对部分许可使用权作出第三人效力安排,保护在先被许可人及善意第三人利益等;但也应注意到个人信息使用许可的特殊性:特殊合同解释及解除规则,不存在独占使用许可,不允许概括性分许可等。在分析个人信息性质及其与知识产权对象相似性的基础上,对个人信息许可使用规则构建提出了具体的建议。The subject of information enjoys both spiritual and property interests for personal information,the property interest can be used by licensing.Research on the personal information licensing rules will help promote the effective use of personal information.In discussing the personal information licensing rules,because personal information and object of intellectual property rights have similar characteristics,in the construction of the rules,the intellectual property licensing model can be referred to.Contract is used to establish personal information licenses,different types of licenses are divided,and third-party effective arrangements for part of the license rights are made,protecting the interests of the first licensee and good faith third parties,etc.;however,attention should be paid to the particularity of personal information licenses:there are special contract interpretation and dissolution rules,there is no exclusive license,and it is not allowed to general sub-licensing.On the basis of analyzing the nature of personal information and its similarity with intellectual property objects,specific suggestions are made on the construction of personal information licensing rules.
