摘 要:在中美贸易规模不断变化的大背景下,知识产权保护成为焦点。除专利外,美国也是商标国际申请的重要目的地国。近年来,以我国为代表的外国在美商标申请量急速增长,个中缘由值得深入探究。为此,选取包括中国在内的23个国家2001—2020年间向USPTO提交的商标申请等多源数据,提出并实证检验了外国在美申请商标的影响因素模型,通过对比发达国家与发展中国家在美商标申请影响因素的异同,明确了我国海外商标发展指向。研究结果显示,保护在目标国的产品/服务、防止商标被其他国家抢先注册、获得商标出售的利润以及两国间的心理距离均对各国在美商标申请行为产生重要影响。对我国来说,一方面要基于收益回报需求加强赴美商标申请,提升品牌竞争力,扩大品牌国际影响;另一方面应创造良好的营商环境,加强对外文化交流,吸引外国企业对华开展商标申请和贸易往来。In the context of the changing scale of Sino US trade,intellectual property protection has become the focus. In addition to patents,the United States is also an important destination for international trademark applications. In recent years,the number of foreign trademark applications in the United States represented by China has increased rapidly,and the reasons are worth exploring in depth. Therefore,this paper selects all trademark applications and other multi-source data submitted to USPTO by 23 countries including China from 2001 to 2020,puts forward and empirically tests the influencing factor model of foreign trademark applications in the United States,and defines the development direction of overseas trademarks in China by comparing the similarities and differences of influencing factors of trademark applications in the United States between developed and developing countries. The results show that protecting products/services in the target country,preventing trademarks from being registered first by other countries,obtaining profits from trademark sales and the psychological distance between the two countries all have an important impact on countries’ trademark application behavior in the United States. For China,on the one hand,we should strengthen trademark application to the United States based on the demand of income and return,improve brand competitiveness and expand brand international influence;On the other hand,we should create a good business environment,strengthen foreign cultural exchanges,and attract foreign enterprises to carry out trademark applications and trade exchanges with China.
