摘 要:公序良俗原则被广泛适用于劳动争议案件,但其并未在我国劳动法中得以明确确立,以致裁判者可能面临超越“依法司法”的风险。由于公序良俗原则的引入契合劳动法演变的私法社会化路径、符合劳资伦理的价值需求、有利于实现构建和谐劳动关系等目标,故而《中华人民共和国劳动法》应当及时对其进行显名化处理。应当注意的是,鉴于劳动关系的特性,公序良俗原则中的公共秩序部分仅可用于规范用人单位的行为,而不应将其适用于劳动者。同时,司法机关还应出台系列指导案例形成案例群以促进该原则的类型化适用。如此,劳动法既可以达到吸收公序良俗原则满足自身需求的目的,也不至于受到民法价值体系的干扰。The principle of public order and good customs is widely used in labor dispute cases,but it has not been clearly established in our country's labor law,so that judges may face the risk of going beyond“judiciary according to law”.Because the introduction of the principle of public order and good customs conforms to the evolution path of the socialization of labor law and private law,conforms to the value demand of labor-capital ethics,and is conducive to the realization of the goal of building a harmonious labor relationship.Therefore,Chinese Labor Law should address it in a timely manner.It should be noted that,given the nature of labor relations,the public order part of the principle of public order and good customs can only be used to regulate the behavior of employers,and should not be applied to workers.At the same time,the judiciary should also issue a series of guiding cases to form a case group to promote the typified application of this principle.In this way,labor law can not only achieve the purpose of absorbing the principles of public order and good customs to meet its own needs,but also will not be interfered by the value system of civil law.
