中国行政法法典化的体系性与民主性取向

摘　　要：法典化可以提升法律的可及性,并产生教育效果,同时增强民主合法性,成为实现快速、系统的法律改革的重要途径。法典化与清晰、稳定且完备的行政法体系相互促动,行政法的体系化能够使行政法法典化顺理成章,而法典化更会使行政法体系日臻完善。故而中国行政法法典化必须持此观念,渐次推动行政法法典中各部分内容的成熟,切不可急于求成。目前可结合行政争议解决机制的完善,特别是行政复议法的修改,探求行政救济法的体系化建构,从而切实解决中国理论和实务中有关行政争议解决所面临的问题。民主性的取向在于强调法典化应尽量清晰、明确,方便接近使用,充分保障公众的行政法权利,更好地满足公众日益增长的法治期待。当然,这也为中国行政法法典化提出了更高的要求,同时亦应当注意法典的开放性及其相关制度的构建。Codification can improve the accessibility of law,produce educational effects,and enhance democratic legitimacy.It has become an important way to realize rapid and systematic legal reform.Codification and a clear,stable and complete administrative law system promote each other,while the systematization of administrative law can make the codification of administrative law logical,and codification will make the administrative law system increasingly perfect.Therefore,the codification of China’s administrative law must insist on this concept and gradually promote the maturity of various parts of the code of administrative law and must not rush for results.At present,people can explore the systematic construction of administrative relief law in combination with the improvement of administrative dispute resolution mechanism,especially the amendment of administrative reconsideration law,so as to effectively solve the problems faced by administrative dispute resolution in Chinese theory and practice.The democratic orientation is to emphasize that the codification should be as clear and accessible as possible,fully protect the public’s administrative law rights,and better meet the public’s growing expectation of the rule of law.Of course,it also puts forward higher requirements for the codification of China’s administrative law.At the same time,we should also pay attention to the openness of the code and the construction of relevant systems.
