行政法法典化背景下我国行政行为理论研究的挑战与应对

摘　　要：如何定位行政行为是目前我国行政法法典化讨论中的一项重要内容。学界提出的行政法法典化模式方案中对行政行为概念的使用、行政行为类型的确定、行政行为效力的规定都存在明显的差异,这在一定程度上反映了我国行政行为理论研究的现状。目前我国关于行政行为的研究面临构建基础理论体系、回应行政法学结构转型、应对中国本土特色问题三重挑战。编纂行政法法典,需要对行政行为的基本概念、行政行为的功能、行政行为在法典中的地位等问题达成基本共识。此外,在全球化背景下,加强行政行为理论比较法研究仍然具有重要意义。How to locate administrative behavior is an important content in the discussion of the codification of administrative law in China.There are obvious differences in the use of the concept of administrative behaviors,the determination of the types of administrative behaviors,and the provisions on the effectiveness of administrative behaviors in the administrative law codification model scheme proposed by the academic circles,which reflects the current situation of theoretical research on administrative behaviors in China to some extent.At present,the research on administrative behavior in China faces three challenges:constructing a basic theoretical system,responding to the structural transformation of administrative law,and responding to the problems with China’s local characteristics.The codification of administrative law requires a basic consensus on the basic concept of administrative behavior,the function of administrative behavior,and the status of administrative behavior in the code.In addition,in the context of globalization,it is still of great significance to strengthen the comparative study of administrative behavior theory.
