摘  要:对于智能网联汽车交通肇事案件,传统罪责刑法对其刑事责任的分配困难重重。在明确智能网联汽车不具备刑事责任主体资格的前提下,结合不同主体对刑事责任进行分配。对于生产者,应引入相对严格责任,结合其主观心态对刑事责任进行分配;对于使用者,结合其注意义务与风险升高理论对刑事责任进行分配;对于第三方侵入者,结合其侵入行为分阶段对刑事责任进行分配;而对于人机混驾模式下的过错竞合,则应用信赖原则对刑事责任进行分配。The traditional criminal law has many difficulties in the distribution of criminal responsibility for traffic accidents caused by intelligent connected vehicles.On the premise that the intelligent connected vehicle does not have the qualification of the subject of criminal liability,the criminal liability is allocated according to different subjects.For producers,relatively strict liability should be introduced and criminal liability should be allocated in combination according to their subjective state of mind.For drivers,the criminal responsibility should be assigned according to their duty of care and the theory of increased risk;for the third-party intruder,the criminal responsibility shall be allocated by stages in combination with his intrusion behavior;for the fault concurrence under the mixed driving mode,the principle of trust is applied to distribute the criminal responsibility.
