摘　　要：成本收益理论聚焦于分析及调控犯罪成本与收益来实现控制和预防犯罪,其认识角度和方法论为治理虚假投资理财类电信网络诈骗犯罪提供了新思路。基于虚假投资理财类电信网络诈骗犯罪的市场供求现状,分析犯罪现实成本、犯罪时间机会成本、预期刑罚成本和犯罪收益,提出应通过打击配套产业、拓宽就业渠道、提高刑罚的确定性与严厉性,以及压低犯罪收益等举措来治理虚假投资理财类电信网络诈骗犯罪。The cost-benefit theory of telecom network fraud focuses on controlling and preventing crimes by analyzing and regulating the cost and benefit of crimes.Its cognitive perspective and methodology provide new ideas for the governance of fraud crimes of telecom network related to false investment and financial management.Based on the current market supply and demand situation of the fraud crime of telecom network in the category of false investment and financial management,this paper analyzes the actual cost,the opportunity cost of crime time,expected penalty cost and criminal benefit of the crime,and puts forward that the fraud crime of telecom network in the category of false investment and financial management should be treated through measures such as cracking down on supporting industries,widening employment channels,improving the certainty and severity of penalties,and reducing the criminal income.
