网络平台个人信息保护责任的法律经济学分析

摘　　要：随着网络领域个人信息侵权事件的日益增多,网络平台的个人信息保护责任已成为社会各界关注的焦点。网络平台和商家的个人信息保护责任划分不清,告知同意机制日益流于形式,个人信息保护手段的威慑效果不足,极大制约了网络平台个人信息保护责任的有效履行。作为以较低成本履行个人信息保护责任的网络平台,应承担个人信息保护的主要责任。网络平台与商家应成为共同个人信息处理者,从而实现个人信息保护责任的内部化,二者之间的关系适用《个人信息保护法》的必要连带责任规则。加强网络平台个人信息保护合规激励机制建设及提高对网络平台违法行为制裁的确定性,是网络平台个人信息保护责任制度的优化路径。With the increase of personal information infringement incidents in cyber realm,the responsibilities for personal information protection of network platforms become the focus.The effective performance of personal information protection responsibilities on network platforms is greatly restricted due to the vagueness of the personal information protection responsibilities between the network platform and businesses in it,the increasingly formalized mechanism of informed consent and the limited deterrent effect of personal information protection methods.Network platforms that perform the responsibility of personal information protection at a lower cost,should be mainly responsible for personal information protection.The network platform and businesses in it should become a joint personal information processor,so as to realize the internalization of personal information protection responsibility.The necessary joint liability rules of the Personal Information Protection Law can be applied to the relationship between the two.Strengthening the construction of the compliance incentive mechanism of the network platform's personal information protection and improving the certainty of the sanctions against the network platform's illegal activities are the optimization paths of the network platform's personal information protection responsibility system.
