委托代理理论视角下医患纠纷的成因及治理

摘　　要：医患纠纷给医疗卫生系统带来了巨大的负面影响,需要创新医患纠纷问题的治理,构建和谐的医患关系。文章基于委托代理理论对我国医患纠纷的成因进行解析并提出治理之策。研究发现,医患委托人和代理人的利益目标不一致、错配以及道德风险是引起医患纠纷的重要原因,患方委托人约束力的弱化、维权的艰难性是增加医患纠纷可能性的重要因素。因此,提出政府、市场、社群等多元主体力量嵌入医患委托代理关系的治理策略,通过促进医患信任、缓解医患错配、防范医患道德风险、强化患者对医务人员的合法约束力、拓宽患者合法维权的渠道并降低维权成本,以期构建和谐的医患关系。Doctor-patient disputes have brought greatly negative impact on the medical and health system. It is necessary to innovate the governance of doctor-patient disputes and build a harmonious doctor-patient relationship. Based on the principal-agent theory, the causes of doctor-patient disputes in China were analyzed, and some countermeasures were put forward. It was found that the inconsistent interest objectives, mismatch and moral hazard of the client and agent were the important reasons for the doctor-patient disputes, and the weakening of the client’s binding force and the difficulties of safeguarding rights were the important factors to increase the possibility of doctor-patient disputes. therefore, the government, market, community and other diversified forces were proposed to embed the governance strategy of doctor-patient principal-agent relationship, so as to build a harmonious doctor-patient relationship by promoting doctor-patient trust, alleviating doctor-patient mismatch, preventing doctor-patient moral hazard, strengthening the legal binding force of patients on medical personnel, broadening the channels of patients’ legal rights protection and reducing the cost of rights protection.
