中国能源革命的法律逻辑

摘　　要：从政党政治肇始的能源革命已经成为正式制度的价值取向,能源革命的速率与绩效却远未达到人们的预期,问题在于作为行动规范或能源对策体系行动规则的法律缺乏对能源革命的制度响应。推动能源革命的法律制度设计俨然成为《能源法》肩负的神圣使命。然而,《能源法》对能源革命的制度设计是有限的,没有推动能源革命的市场经济体制不会有能源革命的法律,没有推动能源革命的法律结构同样不会有推动能源革命的《能源法》。能源革命其实是市场经济体制革命及其市场经济法律结构决定的,《能源法》只有在市场经济体制和市场经济法律结构前提下才会做出能源革命的制度设计。市场经济体制革命和市场经济法律革命才是中国能源革命的制度逻辑。从资源分配型体制向技术竞争型体制转型及其法律制度转型是中国能源革命法律逻辑的路径依赖。While the energy revolution,which began with party politics,has become a formal institutional value proposition,the progress and performance of the energy revolution is far from what was expected.The main problem is that the law,as a system of norms of action or response,lacks an institutional response to the energy revolution.The institutional design to promote the energy revolution has become the sacred mission of the Energy Law.However,the institutional design of the Energy Law is limited with respect to the energy revolution.There will be no law for the energy revolution without a market economy system that promotes the energy revolution,and there will be no Energy Law for the energy revolution without a legal structure that promotes the energy revolution.The energy revolution is actually determined by the market economy institutional revolution and its market economy legal structure,and the Energy Law will only make the institutional design about the energy revolution under the premise of the market economy institutional and market economy legal structure.The market economy system revolution and the market economy legal revolution are the institutional logic of China’s energy revolution.The transition from the resource allocation system to the technology competition system and the transformation of its legal system constitute the path dependence of the legal logic of China’s energy revolution.
