司法责任制改革后如何对检察官做到“放权不放任”?

摘　　要：中央政法队伍全面深化改革推进会要求健全司法责任体系,这是加强监督管理的重要措施。司法责任制改革后出现了办案质量下降、权力失控、监管不力、“放权”不到位、追责难落实等问题,需要引起重视。司法责任制改革后,应加强部门负责人的监督管理职能:一是通过权力清单对分管检察长、部门负责人和办案检察官的权利进行科学配置;二是赋予分管检察长、部门负责人对重大、疑难和复杂案件、不捕、不诉、抗诉等案件的审核权,充分发挥检察官联席会议的功能,优化统一业务应用系统(2.0版),强化司法责任追究;加强对下级检察机关对口业务条线的指导。同时,注意平衡员额检察官办案主体地位与检察长、部门负责人监督管理权之间的平衡。The central political and legal team to deepen reform will require a sound system of judicial responsibility,which is an important measure to strengthen supervision and management.After the reform of the judicial responsibility system,the quality of handling cases,power out of control,supervision is not effective,“decentralization” is not in place,the implementation of the pursuit of responsibility and other issues,need to pay attention to.After the reform of the judicial responsibility system,the supervision and management functions of department heads should be strengthened:first,through the list of powers of the chief prosecutor,department heads and prosecutors in charge of cases to make scientific configuration;second,to give department heads the right to review major,difficult and complex cases,no arrest,no prosecution,resistance to prosecution and other cases,give full play to the function of the joint meeting of prosecutors,optimize the unified business application system(version2.0),and strengthen judicial accountability,strengthen judicial accountability;and strengthen guidance to lowerlevel procuratorial organs on their corresponding business lines.At the same time,attention was paid to balancing the status of post prosecutors as the main body handling cases with the supervision and management powers of the chief prosecutors and department heads.
