摘　　要：医疗过错的认定对于医疗侵权责任的划分具有重要意义,但目前认定标准却存在诸多不足。本文运用法经济学的最小化社会成本、效率、汉德公式等研究方法,分析具体案例,以最优预防水平作为衡量医疗过错的标准,制定医疗过错认定标准和模型,发挥法经济学在医疗侵权个案中过错认定的优势,为医疗过错的认定提供新的方法,弥补现有认定标准的不足。The identification of medical fault is of great significance to the division of medical tort liability,but there are many deficiencies in the current identification standards.This paper uses the research methods of minimizing social cost,efficiency and Hande formula of law and economics to analyze specific cases.Taking the optimal prevention level as the standard to measure medical fault,formulate the standard and model of medical fault identification,and give full play to the advantages of law and economics in fault identification in medical tort cases.To provide a new method for the identification of medical fault,to make up for the shortcomings of the existing identification standards.
