摘  要:《基本医疗卫生与健康促进法》中规定了一些事关医师的义务,这些规定与既往法律法规规章不一致,将影响医师的医疗行为,医师应按照新规定履行这些义务,尊重患者的权利。本文从全部医疗费用的告知、不得过度医疗、尊重患者知情同意权的形式多样化、开展临床试验、研究及医疗要符合伦理要求、尊重患者人格权等五个方面进行探讨与分析,医疗机构针对这些新变化提出应对措施,使医务人员做到依法行医、规范行医,保障患者的合法权益,从而构建和谐社会医患关系。The"Basic Medical Hygiene and Health Promotion Law"stipulates some obligations related to doctors.These regulations are inconsistent with previous laws,regulations,and rules,and will affect physicians'medical behavior.Physicians should perform these obligations in accordance with the new regulations and respect the rights of patients.This article discusses and analyzes from five aspects:notification of all medical expenses,no excessive medical treatment,diversification of forms of respecting patients'right to informed consent,conducting clinical trials,research and medical treatment must comply with ethical requirements,and respecting patients'personality rights.Medical institutions put forward countermeasures in response to these new changes,so that medical staff can practice medicine in accordance with the law and standardize the practice of medicine,protect the legitimate rights and interests of patients,and build a harmonious social doctor-patient relationship.
