古籍数字资源信息网络传播权的困境及对策研究

摘　　要：信息网络传播权是著作权属下重要的财产权能,是在计算机和互联网快速发展的背景下,知识产权作品衍生出的新权利。在古籍数字化大背景下,古籍数字资源的信息网络传播权逐渐受到关注。文章分析了古籍数字资源信息网络传播权中的法律要件以及面临的法律和现实困境,提出以立法行为人、服务提供行为人、著作权行为人视角推动立法实现权利保护、强化作品安全保护义务、实现经济权利重构的具体解决方案。The right of communication through the information network is an important property right under copyright. It is a new right derived from intellectual property works under the rapid development of computer and Internet. Under the background of digitization of ancient books, the right of network communication of ancient book digital resources has attracted more and more attention. This paper analyzes the legal elements of the right of network communication of ancient book digital resources as well as the legal and practical difficulties faced. From the perspective of legislators, service providers and copyright owners, this paper proposes specific solutions to promote legislation to implement the protection of rights, strengthen the obligation of work protection and implement the reconstruction of economic rights.
