摘  要:碳达峰、碳中和发展目标顺应我国可持续发展的内在要求,表明了我国实现绿色低碳发展的决心。当前,环境犯罪严重破坏森林、草原等生态环境,成为实现碳达峰、碳中和目标的一大阻碍。恢复性司法顺应了碳达峰、碳中和的要求,与生态环境犯罪保护法益相契合。在环境犯罪中适用恢复性司法,不仅可以惩罚破坏环境的犯罪分子,还可以维护生态平衡以及环境安全,助推碳达峰、碳中和目标的实现。当前,应通过完善立法、提高专业性、拓宽适用范围、提高有效监督能力、建立健全协调联动机制等措施,以便在涉碳减排案件中更好地适用恢复性司法,助推我国碳达峰、碳中和目标的实现。The development goals of carbon peaking and carbon neutrality conform to the inherent requirements of China’s sustainable development and demonstrate China’s determination for green and low-carbon development. At present,environmental crimes seriously damage the ecological environment of forests and grasslands,and become a major obstacle to achieving the goal of carbon peaking and carbon neutralization. Restorative justice conforms to the requirements of carbon peaking and carbon neutralization,and is in line with the protection of ecological and environmental legal interests. Applying restorative justice to environmental crimes can not only punish criminals who destroy the environment,but also maintain ecological balance and environmental security,and promote the realization of carbon peaking and carbon neutralization. At present,measures such as perfecting legislation,improving professionalism,broadening the scope of application,improving effective supervision ability, and establishing a sound coordination and linkage mechanism should be taken to better apply restorative justice to carbon emission reduction cases so as to promote the realization of the goals of carbon peaking and carbon neutralization in China.
