摘　　要：执法认同是法律认同的重要领域,是社会对执法基于价值认可而形成的心理归属感,是一种以“集体观念”为基础对执法(制度与实践)的象征性认可。过往学界对法律认同的研究缺少对执法认同的关注,而法律认同所关注的个体与国家间的互动,在执法中体现得最为典型。执法认同在法律认同体系中更加具有社会性、实践性和变动性。过去执法认同机制存在机制要素单一、认同标准偏重客观性、认同主体范围小等问题。新时期,在社会关系更加具有复杂性、信息技术广泛应用等新的社会条件下,执法认同发生转型,在机制要素上由单一要素变为复合要素,标准上由客观变为主客观相统一,主体上由直接主体变为大众主体。构建执法认同的根本是形塑认同执法的观念基础。通过观念基础的生产机制和整合吸纳机制,完成执法认同观念基础的形塑。Law enforcement recognition is an important field of legal identity,a psychological sense of belonging formed by the society based on the value recognition of law enforcement,and a symbolic recognition of law enforcement(system and practice)based on the“collective concept”.The previous studies on legal recognition in the academic circle lacked attention to law enforcement recognition,while the interaction between individuals and the state that legal recognition focused on was most typical in law enforcement.Law enforcement recognition is more social,practical and changeable in the system of legal recognition.In the past,there were some problems in the mechanism of law enforcement recognition,such as a single mechanism,more objective in recognition standard,and a small scope of recognition.In the new era,under new social conditions such as more complex social relations and widespread application of information technology,the law enforcement recognition has transformed from single to composite in terms of mechanism elements,from objective to a combination of subjective and objective in terms of standards,and from a direct subject to a public subject in terms of subject.The foundation of constructing law enforcement recognition is to shape the conceptual basis of law enforcement recognition.The formation of the concept-based recognition of law enforcement can be completed through the production mechanism and the integration and absorption mechanism of the concept basis.
