摘　　要：教育行政执法体制改革是建设法治政府的客观需要和重要内容。我国教育行政执法呈现单一执法、联合执法和综合执法三种体制并存,并且逐步转向综合执法体制的发展趋势。比较三种执法体制发现:虽然部门内综合执法和联合执法对专项整治执法的效果显著,但仍存在教育行政部门执法力量不强、联合执法机制不健全等问题;跨部门综合执法能够有效提高执法效率,但存在职权转移依据不足、衔接不畅等问题。推进教育行政执法改革,需要畅通执法衔接机制,深化综合执法实践探索;坚持赋权赋能并举,充分发挥基层镇街组织的作用;加强执法信息化建设,整体提升教育行政执法效能;厘清执法权力边界,完善教育行政执法监督体系。To build a rule of law government,the system reform of educational administrative law enforcement(EALE)is an objective need and a critical content.Nowadays,China’s EALE coexists three types of law enforcement,namely Single Law Enforcement,Joint Law Enforcement,and Comprehensive Law Enforcement,and is in the stage of gradually transforming to a system containing Comprehensive Law Enforcement.By comparing the above-stated law enforcement ways,it can be found that within-department Comprehensive Law Enforcement and Joint Law Enforcement play significant roles in Special Law Enforcement.However,there are still some problems such as the weak law enforcement force of the education administrative departments and the unsound joint law enforcement mechanism;Cross departmental comprehensive law enforcement can effectively improve the efficiency of law enforcement,but there are some problems such as insufficient basis for power transfer and poor convergence.Therefore,to better improve reform in EALE,the government needs to deepen the system reform of comprehensive education law enforcement,so as to smooth the interface mechanism between law enforcement departments.Also,the government is supposed to adhere to empowerment,thereby giving full play to the role of grassroots town and street organizations.In addition,the government stands in the need of strengthening the information construction of law enforcement departments,and thus improve the overall effectiveness of education administrative law enforcement.Moreover,the government demands to clarify the power boundaries of law enforcement departments so that it can improve the supervision system of education administrative law enforcement departments.
