习近平法治思想指导下海关治理法治化理论与对策研究

摘　　要：“坚持在法治轨道上推进国家治理体系和治理能力现代化”是习近平法治思想的核心命题。站在新的历史起点上,海关应以习近平法治思想为指导,在法治轨道上推动监管制度创新和治理能力现代化建设。为实现上述目标,本文在学习领悟习近平总书记重要论述精神及分析相关文献的基础上,归纳了海关治理法治化的理论渊源,对标习近平法治思想核心要义,综合运用文义解释、体系解释、目的解释等方法厘清海关治理法治化的核心内涵;并以习近平法治思想作为海关治理法治化的根本遵循,采用实证调查、案例分析的方法定性评价法治海关建设现状,查摆短板与不足;针对现实存在的问题与挑战进行科学分析和对策研究,在突出海关治理法治化的政治性、人民性、引领性、道德性、实践性等方面,提出推动海关治理法治化的具体建议。“Adhering to the rule of law in advancing the modernization of China’s system and governance capacity” is the core proposition of Xi Jinping Thought on the Rule of Law.Standing at a new historical starting point, China Customs should take Xi Jinping Thought on the Rule of Law as the guide, and promote the innovation of customs procedures and the modernization of governance capacity under the rule of law.In order to achieve the goal, this paper summarizes the theoretical origin of the rule of law in customs governance, on the basis of the grasp of the spirit of General Secretary Xi Jinping’s important expositions and analysis of relevant literature.In compliance with the core essence of Xi Jinping Thought on the Rule of Law, it also clarifies the core connotation of the rule of law in customs governance by interpretation of text, system and purpose.And taking Xi Jinping Thought on the Rule of Law as the fundamental guide, it adopts the methods of empirical investigation and case analysis to qualitatively evaluate the current situation of customs development under the rule of law, and investigates its shortcomings and deficiencies.Through scientific analysis and countermeasure research of the existing problems and challenges, the paper puts forward specific suggestions for promoting the rule of law in customs governance characterized by political, people-oriented, pioneering, moral, and practical advantages.
