摘　　要：对《马拉喀什条约》的人权属性进行深入分析,可以厘清版权和人权是否存在冲突等理论问题,有助解决在授权实体和无障碍格式等方面的制度设计和法律实施问题。本文从《马拉喀什条约》的背景、定位和内容方面论述条约所蕴含的人权视角,并从《马拉喀什条约》在中国法律体系中的实施出发,提出该条约实施的政策和法律建议。An in-depth analysis of the human rights attributes of the Marrakesh Treaty helps clarify theoretical issues such as whether there is a conflict between copyright and human rights,and resolve issues in the design of instruments and implementation of the law in terms of authorized entities and accessible formats.This paper addresses the human rights perspective contained in the Marrakesh Treaty from its background,positioning and contents,and puts forward suggestions on policies and laws for the implementation of the Marrakesh Treaty in the Chinese legal system.
