摘 要:《区域全球经济伙伴协定》(Regional Comprehensive Economic Partnership,简称RCEP协定)规定了传统的国家之间的争端解决机制,但就投资章节在投资者—国家争端解决机制(Investor-State Dispute Settlement,简称ISDS机制)部分处于谈判协商阶段,对是否建立与选择何种模式的ISDS机制仍在探讨中。本文基于历史经验和现实情况对建立ISDS机制问题做出了肯定回应,并结合ISDS机制的发展与RCEP协定的实际情况,对现有两种ISDS机制和RCEP协定缔结的缔约国整体实力水平进行分析后,认为可针对性采取“商事化模式为主,兼采司法化模式”的改良路径。The Regional Comprehensive Economic Partnership(RCEP Agreement)stipulates a dispute settlement mechanism between states,but the investment chapter in the Investor-State Dispute Settlement(ISDS)is partially in the stage of negotiation,and whether to establish an ISDS mechanism and which mode to choose are still under debate.In light of historical experience and reality,this paper makes a positive response to the establishment of the ISDS mechanism,and after a thorough analysis of the overall strength of the two existing ISDS mechanisms and the contracting parties of the RCEP agreement,it’s argued that the improvement path of“commercial mode as the primary and judicial mode as the secondary”can be adopted.
