摘 要:《长江保护法》实施后,其他法律法规需配合进行联动修改,其中《水法》的联动修改即为重要任务之一。《长江保护法》与《水法》在适用范围、立法理念以及制度机制特性上存在诸多差异。目前,《水法》与《长江保护法》在一些同一事项上存在具体规则上的冲突;相较于《长江保护法》,《水法》的立法理念存在一定程度的滞后性;《长江保护法》中设立的具事前预防性、事后救济性的生态环境保护制度,在《水法》中则暂付阙如。通过修改存在冲突的具体规则、《水法》从立法理念到制度机制的生态化,以实现《水法》与《长江保护法》在保护水资源上的协调与衔接。After the implementation of the Yangtze River Protection Law,other laws and regulations need to be revised in conjunction with each other,among which the revision of the Water Law is one of the important tasks.There are many differences between the Yangtze River Protection Law and the Water Law in the scope of application,legislative ideas,and characteristics of institutional mechanisms.At present,the Water Law and the Yangtze River Protection Law have specific rules conflict on some of the same matters;Compared with the Yangtze River Protection Law,the"Water Law"has a certain degree of lag;The ecological and environmental protection system set up in the Yangtze River Protection Law with pre-prevention and post-relief is absent in the water law.By revising the conflicting specific rules and the ecologicalization of the Water Law from the legislative ideasto the institutional mechanism,the coordination and connection of Water Law and Yangtze River Protection Law in protecting water resources can be realized.
