论人民警察的性质——以《中华人民共和国人民警察法》修订为视角

摘　　要：我国人民警察是国家重要的治安行政和刑事司法力量。这一论断高度概括了人民警察的性质,是《中华人民共和国人民警察法》修订的重要理论基础。首先,人民警察具有特定的主体性,其与警察及警察机关既有联系,又有区别,但并不影响《中华人民共和国人民警察法》的“综合法”定位。其次,人民警察具有鲜明的阶级性,与之相适应,政治建警方针应然纳入《中华人民共和国人民警察法》的总则之中。再次,人民警察具有双重的职能性,《中华人民共和国人民警察法》应当予以明确,这有着重要的理论和实践意义。The people’s police is an important force of national security administration and criminal justice.This assertion highly summarizes the nature of the people’s police and is an important theoretical basis to revise the people’s Police Law.Firstly,the people’s police has a specific subjectivity,which is both related to and distinct from the police and police organs,but does not affect the comprehensive law status of the People’s Police Law.Secondly,the people’s police has a distinct class nature,and in line with this,the policy of police building on political basis should become the general content of the People’s Police Law.And finally,the people’s police has a dual function,and the People’s Police Law should be clarified,which has important theoretical and practical significance.
