摘　　要：在数据时代的今天,信息发展和传播的速度、广度以及数量均远远超过了以往任何时代。但事物的发展一直充满了辩证与矛盾,信息技术尤其是大数据、人工智能等领域的迅猛发展在给人们带来巨大进步的同时也衍生出许多负能量。在数据时代中,刑事诉讼法律制度的发展也必然受其影响。本文拟对数据时代下信息技术对刑事司法实践中的新发展进行阐释,分析这些新发展对传统的程序正义、人权保障等基本理念的挑战,提出平衡之建议。In the era of data today, the speed, breadth and quantity of information development and dissemination are far beyond any previous era. However, the development of things has always been full of dialectics and contradictions. The rapid development of information technology, especially big data and artificial intelligence, has brought great progress to people but also generated a lot of negative energy. In the age of data, the development of criminal procedure law system is bound to be affected by it. This paper intends to explain the new development of information technology in criminal justice practice in the age of data, analyze the challenge of these new developments to the traditional basic concepts of procedural justice and human rights protection, and puts forward suggestions for balance.
